End User License Agreement

This agreement is between you and YelboWorks, Phoenix, Arizona, USA ("YelboWorks", "we", "us"). It covers HardForm and 3D Scan Buddy, including their command line programs, updaters and documentation (together, the "Software"). By installing or using the Software you accept these terms. If you do not accept them, do not install or use the Software.

1. The license

• HardForm is paid software. When you buy it, you receive one perpetual license for one person (the licensee). The license does not expire.
• 3D Scan Buddy is free. You may install and use it at no charge under the restrictions in section 2.
• A HardForm license is per user, not per computer. You may activate it on up to 20 devices, all of which must be used only by you. A license cannot be shared between people or used by a team on one key; each user needs their own.
• The license is non-exclusive and non-transferable except as section 2 allows. You may use the Software for any lawful purpose, personal or commercial, including parts, drawings and toolpaths you make with it. You own what you create; we claim no rights to your files.

2. Restrictions

You may not:

• copy the Software except for installation, backup and normal use on your activated devices;
• reverse engineer, decompile or disassemble the Software, or try to extract its source code, except to the extent the law allows despite this restriction;
• sell, resell, rent, lease, sublicense, lend or give away the Software or your license key, or publish a key so that others can use it;
• remove or alter copyright notices, or work around the license activation or its limits;
• use the Software to build a competing product from our code, or to offer it as a hosted service.

Open-source components included in the Software remain under their own licenses, which are listed in the Software's About dialog or its documentation. Those licenses apply to those components instead of this agreement.

3. Updates

Your HardForm license includes all updates, major and minor, for as long as we publish them, at no extra charge. We may change features between versions. We do not promise to keep releasing updates or to support every operating system forever, but a version you have installed keeps working under your perpetual license.

4. Ownership

The Software is licensed, not sold. YelboWorks and its licensors keep all rights in it that are not expressly granted here. The names HardForm, 3D Scan Buddy and YelboWorks, and their logos, are our marks.

5. Payment and purchases

HardForm is sold by Lemon Squeezy, which acts as the merchant of record. Lemon Squeezy is the seller: it handles payment, taxes, invoices and refunds, and its own terms apply to the purchase. See our refund policy for the 30-day money-back guarantee.

6. Disclaimer of warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

HardForm produces geometry, drawings and machine code (G-code). You are responsible for checking every output before you manufacture, cut, print or run it, including toolpaths, dimensions, tolerances, post processor output and simulations. Machines can injure people and destroy workpieces. Use proper setup, workholding, guarding and judgment.

7. Limitation of liability

TO THE MAXIMUM EXTENT THE LAW ALLOWS, YELBOWORKS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, DOWNTIME, DAMAGED MACHINES, TOOLS OR WORKPIECES, OR THE COST OF SUBSTITUTE GOODS, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSE (OR US$50 IF THE SOFTWARE WAS FREE). Some places do not allow these limits; where that is so, they apply only as far as the law permits, and nothing here limits rights you cannot waive.

8. Termination

This agreement lasts as long as you use the Software. We may end your license if you materially break these terms, for example by sharing or reselling a key; the license may also end if a purchase is refunded or reversed (see the refund policy). When it ends, you must stop using the Software and delete your copies. Sections 2, 4, 6, 7 and 9 survive termination.

9. Governing law

This agreement is governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law rules. The state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction over disputes, and you consent to that jurisdiction, except where the law where you live gives you the right to bring a claim elsewhere.

10. General

This is the whole agreement about the Software and replaces earlier understandings. If a provision is unenforceable, the rest stays in force. Not enforcing a term is not a waiver of it. We may update these terms for future versions of the Software; the date at the top shows when they last changed. You may not assign this agreement without our consent; we may assign it with the Software.
